The European Commission has proposed the EU Kids Act (Keeping Internet Digital Services Trustworthy & Accountable Act), a legislative framework aimed at regulating online services for minors. The proposal specifically includes video games, video game platforms, and online games within its scope. Key obligations include assuming all users are minors until age verification proves otherwise, implementing age ratings enforced by app stores, and restricting features like unsolicited contact, geolocation, and engagement mechanics such as daily streaks and re-engagement notifications. Games must disable certain features by default, set push notifications off by default, and avoid designs that encourage compulsive use. The proposal also addresses AI companions and chatbots in games. The European Parliament and Council will now negotiate the text, with a process expected to take 8-24 months. Meanwhile, a Digital Fairness Act is anticipated in autumn 2026, which may impose further obligations.
The European Union is advancing a trio of regulations that collectively pose a significant threat to the mobile gaming industry. The upcoming Digital Fairness Act (DFA) targets monetization mechanics like loot boxes and addictive features, potentially impacting in-app purchases. The newly announced EU Kids Act, under Article 15, would restrict engagement techniques such as daily log-in bonuses and activity streaks for minors, requiring age assurance for all users. Additionally, the Digital Services Act (DSA) guidelines on protecting minors are already in effect. Industry experts warn of 'catastrophic' impacts and draw parallels to the IDFA privacy changes that disrupted mobile advertising. The final wording of the EU Kids Act is still under negotiation, with potential finalization by the end of the decade.

CNBC's Investing Club analyzes the debate through game theory, specifically the prisoner's dilemma, to assess the likelihood of a coordinated slowdown in AI development. They argue that while both the U.S. and China might benefit from mutual pacing, enforceable cooperation is impossible, making a slowdown unlikely. This conclusion is based on geopolitical competition and the Nash equilibrium, suggesting that AI spending and development will continue at a rapid pace. The article cites support and opposition from various tech leaders and emphasizes geopolitical dynamics as a key factor.
