Karlsruhe Court Hears German Public-Broadcaster Fee Dispute

Germany's Federal Constitutional Court held an oral hearing on a constitutional complaint from public broadcasters ARD and ZDF after several federal states refused to follow the KEF's recommendation to raise the monthly broadcasting fee. ARD and ZDF filed their complaint at the end of 2024 and have asked the court for a Vollstreckungsanordnung (enforcement order) to secure the KEF-recommended increase. Senior broadcaster leaders — including ARD chair Florian Hager, ZDF chief Norbert Himmler and MDR intendant Ralf Ludwig — are expected in Karlsruhe. The court may order an increase, defer action to the federal states, or issue guidance on reforming the contribution-setting procedure.

MDR Pauses Crime Series and Cuts Programs Over Budget

Boris Lochthofen, since April 1 Program Director for Leipzig/Halle at public broadcaster MDR, discusses recent program cuts made to stabilise the broadcaster’s budget. MDR will pause new productions of Tatort and Polizeiruf 110 for three years, transfer the Mittagsmagazin to NDR, and end MDR um 2. The measures are framed as necessary after prolonged underfunding following a missing broadcast-fee adjustment and regional demographic declines that reduce contribution revenue. MDR aims to protect core regional journalism, consolidate the Leipzig and Halle program directorates (to be operational early next year) and reallocate some freed resources for streaming and regional formats. Lochthofen says four more crime films will still be produced (two already shot) and warns that if a planned contribution increase to €18.64 from 2027 does not occur, further cuts (approximately €30 million) would be required.

MDR Chief Says Broadcaster Didn't Overspend

MDR director-general Ralf Ludwig told Der Spiegel that the broadcaster must implement major savings after the recommended increase in the German broadcasting fee was not enacted. The cuts include a three-year production pause for Tatort and Polizeiruf, removal of shows such as "MDR um 2" and handing off the "Mittagsmagazin," plus numerous other reductions. Ludwig said the MDR reduced reserves in line with KEF guidance and disputed claims the station had lived beyond its means, blaming state governments for not following KEF's recommended fee rise to €18.94. He also warned that if the AfD were to terminate the broadcasting treaties, the MDR would face legal and operational uncertainty (a two‑year notice would delay changes until after 2028) and that roughly €150 million of program funding could be lost.
