The court has blocked a disputed provision in Meta’s new commercial terms that could give the tech giant extensive rights to collect and use journalistic content from publishers’ websites.

ECJ Bolsters Publishers Against Meta
The European Court of Justice (ECJ) ruled that EU member states may grant press publishers a right to appropriate remuneration when online services such as Meta or Google use their publications. The judgment upholds Italy’s implementation of the EU Copyright Directive — which Meta had challenged — finding that limitations on companies' freedom are justified to support a fair copyright market and media plurality. The court stressed publishers must retain the option to refuse or grant free consent, and platforms that do not use publishers' content cannot be obliged to pay. Switzerland’s publishers’ association (VSM) sees the ruling as supportive for domestic debates on a neighbouring Leistungsschutzrecht.
Publishers Push Back Against Meta's New Terms
The Swiss media association VSM is opposing Meta's new terms of service, which would allow the US tech giant to use journalistic content from publisher websites for AI training without explicit consent or compensation. The publishers are supporting a demand by the World Association of News Publishers (WAN-IFRA) to suspend the regulation, which takes effect on October 30. Despite Meta removing an explicit reference to AI training after criticism, the use of content for AI services remains possible. The VSM is urging the Swiss parliament to quickly implement a motion by FDP Councillor of States Petra Gössi, which calls for better protection of intellectual property against misuse by AI providers. Specifically, the motion aims to prevent AI providers from commercially using copyrighted content without the consent of rights holders.
